DISTANCE SELLING CONTRACT

1. PARTIES

This Distance Selling Contract (“Contract”) has been established in the electronic environment between the SELLER, whose details are provided below, and the BUYER, who makes a purchase via the www.asfalttr.com website, in accordance with the provisions of the Law No. 6502 on the Protection of the Consumer and the relevant Regulation on Distance Contracts.

BUYER INFORMATION

The BUYER's name, surname, address, phone number, e-mail address, and other order information consist of the details provided by the BUYER during the order placement via www.asfalttr.com.

2. SUBJECT OF THE CONTRACT

The subject of this Contract is to determine the rights and obligations of the parties regarding the sale and delivery of the product or products that the BUYER has ordered electronically via the www.asfalttr.com website.

The basic features of the product, sales price, campaign and discount information, payment method, delivery conditions, and shipping costs (if any) are displayed to the BUYER before the order is placed.

3. PRODUCT AND ORDER INFORMATION

The name, basic features, quantity, unit price, discount amount, shipping cost, total sales price including taxes, and payment method of the product(s) subject to the order consist of the information specified on the website and in the order summary at the time the BUYER places the order.

The BUYER declares that they have reviewed and accepted the basic features of the products and the total amount to be paid before confirming their order.

4. PAYMENT

The BUYER pays the order total using one of the payment methods offered on www.asfalttr.com.

If offered on the site, the payment methods can be:

• Credit/Debit Card

• Bank Transfer/EFT

• Payment at the Door

Campaigns, discounts, coupons, and promotions are valid only within the specified terms and periods.

5. DELIVERY

Orders are sent to the delivery address specified by the BUYER during the order.

The SELLER is obliged to deliver the product subject to the order within the period specified or promised during the order. Subject to the exceptions specified in the legislation, the delivery period for the sale of goods cannot exceed the maximum legal period.

The SELLER cannot be held responsible for delays caused by the BUYER providing incorrect or incomplete delivery information, to the extent that there is no fault on the part of the SELLER.

The SELLER is responsible for loss and damage that may occur during transport until the product is delivered to the BUYER or to a third party designated by the BUYER, within the scope of the relevant legislation.

6. RIGHT OF WITHDRAWAL

The BUYER has the right to withdraw from the contract within 14 days without showing any reason and without paying any penalty, starting from the date of receipt of the product, excluding products and contracts determined by law as exceptions to the right of withdrawal.

The BUYER may also exercise the right of withdrawal before the product is delivered to them.

To exercise the right of withdrawal, notification must be made to the SELLER in writing or via a permanent data storage device such as e-mail within the legal period.

7. RETURN PROCEDURES

The BUYER is obliged to send the product back to the SELLER within the period specified in the current legislation from the date they notify the exercise of the right of withdrawal.

The returned product must be sent with its invoice, accessories, and other parts sent with the product, as far as possible.

If the right of withdrawal is exercised in accordance with the procedure, the refund of the product price is carried out in accordance with the period and conditions specified in the current legislation.

Unless otherwise provided by law, the refund is made in accordance with the payment method used by the BUYER during the purchase and without imposing any additional costs on the BUYER.

8. CIRCUMSTANCES UNDER WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

The right of withdrawal cannot be exercised for products and services determined by law as exceptions.

In this context, especially;

• Products prepared in line with the BUYER's special requests,

• Products that can deteriorate quickly or have a short expiration date,

• Products unsuitable for return in terms of health or hygiene if their packaging, seal, tape, or similar protective elements have been opened after delivery,

• Products that are mixed with other products after delivery and cannot be separated due to their nature,

• Other goods and services specified as exceptions to the right of withdrawal in the legislation,

the right of withdrawal cannot be exercised.

These exceptions apply only to the extent permitted by the nature of the product and the applicable legislation.

9. DEFECTIVE, MISSING, OR DAMAGED PRODUCTS

If the BUYER determines that the product they have received is defective, missing, incorrect, or damaged, it is recommended to contact Asfalt.

The BUYER's optional rights arising from the Law No. 6502 on the Protection of the Consumer and relevant legislation regarding defective goods are reserved.

10. INABILITY TO SUPPLY THE PRODUCT

If the delivery of the product subject to the order becomes impossible, the SELLER notifies the BUYER in accordance with the current legislation and refunds the collected amounts to the BUYER within the legal period.

The mere fact that the product is not in stock is not considered as the sole basis for the impossibility of delivery.

11. CAMPAIGNS AND DISCOUNTS

Campaigns such as Buy 3 Pay 2, bulk purchase, free shipping, coupons, and other discount campaigns organized on www.asfalttr.com are applied within the scope of the conditions specified in the relevant campaign.

In campaign orders, if the campaign conditions are no longer met as a result of returning one or more of the products, the refund amount is calculated by taking into account the effect of the campaign on the order and the current consumer legislation.

Campaign provisions cannot be applied in a way that eliminates the BUYER's consumer rights arising from the law.

12. FORCE MAJEURE

In cases of force majeure such as natural disasters, war, terrorism, pandemics, general transport interruptions, decisions of public authorities, and similar situations that develop beyond the control of the parties, the obligations of the parties are evaluated within the framework of the nature of the event and the applicable legislation.

13. SETTLEMENT OF DISPUTES

For disputes arising from this Contract, the BUYER may apply to the authorized Consumer Arbitration Committees or Consumer Courts within the scope of the Law No. 6502 on the Protection of the Consumer and within the current monetary limits.

The BUYER's other rights to apply and file lawsuits arising from the applicable legislation are reserved.

14. PRE-INFORMATION AND ACCEPTANCE

The BUYER acknowledges and declares that they have been informed about the basic features of the products subject to the order, sales price, payment method, delivery conditions, shipping, right of withdrawal, and other sales conditions before placing the order, and have given the necessary confirmation in the electronic environment.

The BUYER acknowledges that they have been informed that confirming their order entails a payment obligation.

15. ENTRY INTO FORCE

This Distance Selling Contract enters into force upon the BUYER completing their order on www.asfalttr.com and confirming the contract in the electronic environment.

A copy of the contract can be made available to the BUYER in the electronic environment and/or sent to the e-mail address provided during the order.
